The terms and conditions of our business are as:-

 

 

1.   In the absence of any specially agreed conditions, confirmed in writing, the following shall apply to all schemes and                   contracts undertaken by Pathways of Scarborough Ltd.  Any disputes within the UK will be governed by the law of England       and Wales.

 

2.   All prices quoted are valid for a period of 4 weeks from the date of quotation, and thereafter may be subject to any                     increases in labour, transport, plant and materials costs until an signed acceptance of order is received.

 

3.   Quoted rates are subject to VAT, currently at 20%, unless the quotation clearly states that prices are inclusive of VAT.

 

4.   Works will be carried out to a maximum credit limit of £5,000 (£500 in respect to power washing) after which an interim             invoice will be issued and will require immediate payment before continuing with the completion of works.

 

5.   Quotations are given on the basis of free access to the relevant site through a pre-arranged agreement.

 

6.   If required, and upon mutual agreement, the customer agrees to accept site delivery of materials required for the scheme,       prior to the commencement of the works.

 

7.   In the event that the customer requires changes to the quoted works to be carried out, a revised quote and/or written                 agreement will be made by both parties.

 

8.   In the unlikely event that Public Utilities underground cables, pipe work and ducting are not at a statutory depth and within         our construction works, the lowering of this equipment will have to be undertaken by your local Public Utilities Company.

 

9.   Whilst every effort will be made to confirm the suitability of the surface to be treated, Pathways of Scarborough Ltd cannot         be held responsible for the structural sub-surface, or the condition of existing surfaces when laid by others.  It is the                   customers responsibility to inform Pathways of Scarborough Ltd of any existing and unwanted pooling prior to works                 commencing.

 

10. The title to all materials supplied remains the property of Pathways of Scarborough Ltd until full and final settlement has             been received.  Pathways of Scarborough Ltd retains the right to access the site to remove and/or reclaim all materials             laid/used by Pathways of Scarborough Ltd in the event that full payment for the completed works has not been received.

 

11. In the absence of prior agreement, formalised in writing, payment for the completed works will be due as detailed on the           invoice, normally 10 working days (power washing is upon completion of work – see below).

 

12. In the event that payment is not received by the due date, we reserve the right to charge interest calculated on a daily               basis as determined and in accordance with the “Late Payment of Commercial Debts (Interest) Act 1988″

 

13. We accept payment by cash, cheque or bank transfer (details as shown on the invoice).

 

In respect of power washing, the following will also apply:-

 

14. Generally drive ways, patios and paths are cleaned using only a high pressure water jet and cold water.

 

15. Loose or damaged surfaces (i.e. uneven flags, erosion, pointing) can potentially be further damaged by high pressure               water.  We will not be held liable for further damaged caused.  We will advise you of preventative treatment you can make         before or after cleaning, and provide a written quotations for such treatment.

 

16. When cleaning block paving, we will replace the sand driven out whilst washing.

 

17. Tarmac cleaning may require 2 visits as moss can be deeply embedded.  A quotation can be provided to reseal the tarmac       after washing.

 

18. Pathways of Scarborough Ltd will aim to preserve and protect plants and borders; however you are responsible for                   providing additional protection.  Moss prevention and cleaning products are not generally used; however this can be                 discussed at the time of the site visit.

 

19. In the absence of prior agreement, formalised in writing, payment for the completed works will be required upon completion       of the works, and no later than 7 days.
